Terms of Service

Welcome to Track Your Tiny Baby ("the App"). These Terms of Service ("Terms") govern your use of the App developed by Ramazan Ocak. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

Track Your Tiny Baby is a comprehensive baby activity tracking application designed for parents, guardians, and caregivers. The App allows you to:

• Track feeding sessions (breast, bottle, solid food), sleep patterns, diaper changes, and pumping records.
• Monitor growth with weight, height, and head circumference measurements.
• Track developmental milestones (motor, cognitive, social, language).
• View statistics, trends, and daily summaries of your baby's activities.
• Generate doctor-ready PDF reports.
• Share baby tracking with family members through household groups.
• Receive push notifications when family members log activities.
• Use Live Activities (iOS 16.1+) for real-time sleep and feeding tracking on the lock screen.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the App. The App is intended for parents, legal guardians, and authorized caregivers only.

3. Account Registration & Security

To access certain features, you must create an account using Apple Sign In or Google Sign In. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the App only for its intended purpose of tracking baby activities. You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Attempt to gain unauthorized access to the App's systems, servers, or other users' data.
• Reverse engineer, decompile, or disassemble any part of the App.
• Interfere with or disrupt the App's services or infrastructure.
• Upload malicious content or attempt to exploit vulnerabilities.
• Share your account credentials with unauthorized parties.
• Use automated systems (bots, scrapers) to access the App.

5. Household & Family Sharing

The App supports collaborative baby tracking through household groups:

• When you create a household and invite members via an invite code, you grant those members access to view and manage your baby's activity data.
• As the household owner, you can add or remove members and assign roles (co-parent or caregiver).
• Co-parents have full access to all features. Caregivers have limited permissions (cannot edit baby profiles).
• Invite codes expire after 48 hours for security purposes.
• You are responsible for managing who has access to your household.
• When a member is removed, they lose access to the household's data immediately.

6. Subscriptions & Payments

The App offers both free and premium features. Premium features are available through auto-renewable subscriptions.

a) Free Features: Basic activity tracking (feeding, sleep, diaper), daily view, and family sharing.

b) Premium Features (RADLE Pro): Growth charts with WHO percentiles, detailed statistics and analytics, developmental milestone tracking, leap week tracking, doctor report generation, photo journal, and advanced sleep analysis.

c) Subscription Plans:

• Monthly Plan: Billed monthly. Auto-renews each month.
• Yearly Plan: Billed annually. May include a free trial period.

d) Payment Terms:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions).
• Any unused portion of a free trial period will be forfeited when you purchase a paid subscription.
• Prices may vary by region and are displayed in your local currency in the App.

e) Refunds: All purchases are processed by Apple. Refund requests must be submitted to Apple directly through their support channels.

7. User Content & Data Ownership

You retain full ownership of all data you enter into the App, including:

• Baby profile information (name, birth date, photo).
• Activity records (feeding, sleep, diaper, pumping, solid food).
• Growth measurements and milestone records.
• Notes, photos, and any other content you provide.

By using the App, you grant us a limited, non-exclusive license to store, process, synchronize, and display your content solely for the purpose of providing the service to you and your household members. We do not use your content for any other purpose.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes in detail how we collect, use, store, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

9. Intellectual Property

The App, including its design, code, graphics, animations (Lottie), icons, and text content, is the intellectual property of Ramazan Ocak and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without prior written permission.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We specifically disclaim:

• Any warranty that the App will be uninterrupted, error-free, or free of harmful components.
• Any warranty regarding the accuracy or reliability of any information obtained through the App.
• Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

IMPORTANT MEDICAL DISCLAIMER: The App is NOT a medical device and should NEVER be used as a substitute for professional medical advice, diagnosis, or treatment. Activity tracking data, growth percentiles, developmental milestones, and any other information provided by the App are for informational and reference purposes only. Always consult your pediatrician or qualified healthcare provider for any medical concerns about your baby. In case of emergency, contact your local emergency services immediately.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ramazan Ocak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the App, including but not limited to:

• Loss of data or data corruption.
• Loss of profits or revenue.
• Personal injury or property damage.
• Any decisions made based on information provided by the App.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ramazan Ocak from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or for any other reason. You may stop using the App and request account deletion at any time by contacting us. Upon termination:

• Your right to use the App ceases immediately.
• We may delete your data in accordance with our Privacy Policy.
• Active subscriptions must be cancelled separately through Apple.

14. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will notify users through the App or via email. The "Effective Date" at the top indicates when the Terms were last updated. Continued use of the App after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the App.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ramazan Ocak regarding your use of the App and supersede any prior agreements or understandings.
